• DISPUTE RESOLUTION POLICY ACETUTE LIMITED (“AceTute”, “We/we” or “Us/us”) strives to ensure that all disputes between AceTute and you, in relation to your use of the user interface, mobile application and software (referred to as “AceTute portal”), are resolved amicably. This Dispute Resolution Policy applies to any and all disputes, claims and actions that may arise in relation to your use of the AceTute portal. AceTute reserves the right to amend the Disputes Policy from time to time and you will be notified about the same.


    (a) “Courses” shall mean all educational courses listed on the AceTute portal;
    (b) “Course Credits” shall mean the credits purchased by a Member on the AceTute portal for enrolment in a particular Course;
    (c) “Member” shall mean a person who completes the account registration process as set out in the Terms and Conditions and
    (d) “Tutorial” shall mean a session that forms a part of the Courses provided in the AceTute portal.


    (a) AceTute has designated its representative as the grievance officer ( “Grievance Officer”) to resolve disputes between AceTute and the Members that may arise in relation to their use of the AceTute portal. The contact details of the Grievance Officer are as follows:

    (b) In the event a Member has any grievances regarding the services of AceTute or otherwise, including but not limited to:
    (i) rescheduling the Tutorials;
    (ii) refund of the Course Credits;
    (iii) use of the AceTute portal and/or the account of the Member created on the AceTute portal;
    (iv) quality of the Courses provided on the AceTute portal;
    (v) applicability and/or interpretation of any terms in relation to your use of the AceTute portal; and
    (vi) such other aspects as the case maybe,
    the Member shall send an intimation to the Grievance Officer on the abovementioned e-mail ID regarding the same. Such intimation will be detailed so as to cover the grievance and provide all necessary documents/information in support of their grievance. Failure to provide necessary information / documents to the Grievance Officer will be a deemed waiver of the rights of the Member to pursue grievance further.
    (c) Within a period of 14 days from the receipt of such intimation, the Grievance Officer shall verify the facts of the case and shall give its decision as regards the dispute.
    (d) The decision of the Grievance Officer shall be binding on AceTute and the Members. You agree and undertake that you shall not seek any legal remedy against AceTute prior to approaching the Grievance Officer.


    (a) Your use of the AceTute portal and all your rights and obligations in relation to the same shall be construed in accordance with and be governed by the laws of India;
    (b) Nothing contained herein shall, (subject to applicable law), limit the right of AceTute to initiate proceedings in any other court of competent jurisdiction, and you waive any objection you may have now or in future in relation to the same.


    (a) Any dispute that may arise with respect to the decision of the Grievance Officer shall be first settled through mutual discussion and amicable settlement failing which the same shall be referred to a mutually appointed sole arbitrator according to the Arbitration and Conciliation Act, 1996 and the rules made thereunder. The seat and venue of arbitration shall be Mumbai and the arbitration shall be conducted under the governing law as set out in paragraph 3 above.
    (b) All proceedings in any such arbitration shall be conducted in English.
    (c) The arbitration award shall be final and binding on AceTute and the Member and they agree to be bound by the same and act accordingly.
    (d) The arbitrator may (but shall not be required to) award to a party substantially on merits, its costs, and reasonable expenses (including reasonable fees of its counsel).
    (e) When any dispute is under arbitration, except for the matters under dispute, AceTute and the Members shall continue to exercise their respective rights and perform their obligations in relation to the AceTute portal.
