PAYMENTS AND REFUNDS POLICY Your purchase of and payment and refund of Course Credits for Courses (as defined below) shall be regulated by this Payment Policy (“Payment Policy”) read with the Terms and Conditions for usage of the AceTute portal (as defined below).
ACETUTE LIMITED (“AceTute”, “We/we” or “Us/us”) strives to ensure clear understanding of financial relations between AceTute and you in relation to the Courses we offer on the user interface, mobile application and software (referred to as “AceTute portal”). This Payment Policy applies to all services and features made available through the AceTute portal. AceTute reserves the right to amend the Payment Policy from time to time and you will be notified about the same.
(a) “Courses” shall mean all educational courses listed on the AceTute portal;
(b) “Course Credits” shall mean the credits purchased by a Member on the AceTute portal for enrolment in a particular Course;
(c) “Member” shall mean a person who completes the account registration process as set out in the Terms and Conditions and
(d) “Tutorial” shall mean a session that forms a part of the Courses provided in the AceTute portal.
2. PAYMENT TERMS
The personal information that we may collect about you broadly falls into the following categories:
(a) In order to avail Courses on the AceTute portal, the Member will have to purchase Course Credits available on the AceTute portal.
(b) If an enrolment is requested for any Course via the AceTute portal, we will either approve or reject the enrolment request within a period of 2 days from the date of request for enrolment (“ Enrolment Request Period ”), otherwise the enrolment request will automatically expire.
(c) The Course Credits payable for a particular Course will be displayed to the Member before the Member sends an enrolment request on the AceTute portal. AceTute shall collect the Course Credits at the time of the enrolment request subject to clause 2 (b).
(d) If we are unable to confirm or decide to reject an enrolment request within the Enrolment Request Period, the Course Credits collected by us for the requested enrolment will be refunded within a period of 2 days from the expiry of the Enrolment Request Period to the concerned Member. When an enrolment request by a Member is accepted, an email or text message will be sent to such Member confirming the enrolment, depending on the selections made by the Member (“Intimation of Acceptance”).
(e) If an accepted enrolment is cancelled by AceTute (before any classes are provided) for any reason whatsoever, the Course Credits for such Course will be refunded to such Member within a period of 2 days from such cancellation, depending on the selections the Member makes via the AceTute portal.
(f) You agree that AceTute will raise a system generated invoice in relation to the Course for which the Member has enrolled or in relation to any kind of payment done, as per applicable laws. AceTute will raise invoice for the above which shall be inclusive of all applicable taxes.
(g) You agree and acknowledge that the Course Credits purchased cannot be redeemed by you for cash at any point of time. Such Course Credits shall be utilised only for enrolment for Courses on the AceTute portal.
(h) No Intimation of Acceptance will be generated by AceTute till the time the Course Credits are paid by a Member
3. CANCELLATION AND REFUNDS
(a) A Member may reschedule a particular Tutorial for which he/she has enrolled by sending an intimation to AceTute at firstname.lastname@example.org Such requests shall be treated in the manner as set out below.
(b) In the event a Member reschedules a particular Tutorial at any time on or before 48 (forty eight) hours from the commencement of the Tutorial, AceTute shall permit such Member to reschedule such Tutorial subject to availability of the tutors. Please note that AceTute shall not be liable for any loss caused to the Member on account of non-availability of tutors for such rescheduled Tutorial.
(c) It is hereby clarified that while rescheduling of a Tutorial may be permitted as per above, but cancellation of a prefixed session under no circumstance will be permitted. Further, please note that the Member shall not be entitled to refund of any of the Course Credits on account of such cancellation / rescheduling of the Tutorial.
(d) In the event a Member intends to reschedule a particular Tutorial at any time when there are less than 48 (forty eight) hours remaining for the commencement of the Tutorial, such a Member shall neither be entitled to any refund of the Course Credits nor shall he / she be entitled to reschedule the Tutorial.
(e) In the event a tutor on the AceTute portal cancels / reschedules a Tutorial at any time, AceTute shall reschedule such Tutorial for the concerned Members. In such an event, the Member shall be informed about the cancellation / rescheduling of the Tutorial and the revised schedule for the same.
(f) In the event a Member is unable to complete a Tutorial on account of any emergency, issues pertaining to information technology or electricity failure or such other similar reasons, AceTute shall not be liable to refund the Course Credits or reschedule the Tutorial for such Member. However, the Grievance Officer (as defined below) may, at its own discretion, reschedule the Tutorial for such Member on a case to case basis.
(g) In the event a tutor on the AceTute portal is unable to complete a Tutorial on account of any emergency, issues pertaining to information technology or electricity failure or such other similar reasons, AceTute shall reschedule the Tutorial for the concerned Members. In such an event, the Member shall be informed about the revised schedule for the same. Please note that AceTute shall not be liable to refund any Course Credits in such a scenario.
(h) You may provide us with your valuable feedback at email@example.com. In case you are dissatisfied with our Courses, you may seek a refund of your Course Credits within a period of 7 (seven) days from the date on which the Tutorial was provided. In such a scenario, you will be required to give reasons for your dissatisfaction along with such other information as may be requested by the Grievance Officer (as defined below).
(i) Please note that AceTute reserves its right to reject your request for refund of the Course Credits at its sole discretion. Any decision in relation to the refund of the Course Credits shall be taken by the Grievance Officer (as defined below) within a period of 14 days from the date on which you seek refund of your Course Credits.
(j) Please note that you shall not be entitled to refund of your Course Credits in the event you intimate your dissatisfaction in relation to a Course upon expiry of a period of 7 (seven) days from the date on which the first Tutorial of such Course was scheduled.
In the event of a chargeback by a credit card/debit card company or any other payment provider, in connection with your purchase of any Course Credits on the AceTute portal, you agree that we may suspend access to any and all accounts that you may have on AceTute portal until all amounts due and payable by you to AceTute have been received by AceTute. In the event AceTute incurs any charges as a result of chargebacks or other payment disputes brought by you, your bank or a payment provider, the same shall be borne by you forthwith.
5. DISPUTES AND REDRESSAL MECHANISM
(a) AceTute has designated its representative as the grievance officer (“Grievance Officer”) to resolve disputes between AceTute and the Members in relation to the refund of Course Credits or rescheduling of Tutorials on the AceTute portal.
